Social Security Disability
When you have a disability, gainful employment is sometimes just not possible. In such cases, it may be necessary to seek income through Social Security. Although there are somewhat strict limitations on what constitutes a disability, there are many conditions that may qualify individuals to receive Social Security benefits.
The Social Security Administration (SSA) administers a number of different programs. Two programs that provide benefits based on disability are:
- the Social Security Disability Insurance program (Title II) and
- the Supplemental Security Income (SSI) program (Title XVI).
There are five levels of applying for disability benefits:
- Initial
- Reconsideration
- Hearing
- Appeals Counsel
- Federal District Court Appeal
In order to qualify for either program, you must be unable to engage in any substantial, gainful activity by reason of any medically determinable physical or mental impairment which can be expected to result in death or which has lasted or can be expected to last for a continuous period of not less than 12 months.
There is no "middle ground," or "partial disability." You are either disabled or not disabled, according to Social Security standards. There are no "percentage ratings," which are customary in workers' compensation cases. However, case law notes that one does not have to be "bedridden," a "basket case," or "at death's door," to qualify for Social Security Disability benefits.
